read these policies, as purchasing our hosting services you agree to be bound by these terms of service. If you are unclear about any of these provisions, or would like more information, please contact us.
TYPES OF SITES
Mirz-Jiles.net hosts
a variety of websites, however we focus our attention on hosting services for
personal and small to mid-sized businesses. Due to the family nature of our hosting service, we
reserve the right to refuse service to sites with content we feel is not in line with our
personal beliefs and business principals.
The following site-types are prohibited and warrant immediate suspension and/or termination without refund:
Adult or Sexually Oriented Sites. This means no graphic nudity or porn, including, but not limited to illustrations, cartoons, or graphic art. All material should be suitable for children to view.
Illegal Activities. Mirz-Jiles Hosting's services may not be used for illegal purposes, or in support
of illegal activities. Mirz-Jiles Hosting reserves the right to cooperate with
legal authorities and/or injured third parties in the investigation of any suspected
crime or civil wrongdoing. The customer agrees to indemnify and hold Mirz-Jiles.net
harmless from any claims resulting from the use of our services.
Types of illegal sites which are against our terms of service include, but are not limited to:
Pirated Software
Hate sites
Hacker focused sites
Hack programs and archives
Unauthorized display or distribution of copyrighted material
Harm or Endangerment to Other People. You may not use Mirz-Jiles Hosting's
services to harm, or attempt to harm, minors in any way, including, but not limited
to child pornography, or the transmission any material (by
e-mail, uploading, posting or otherwise) that threatens or encourages bodily
harm or destruction of property.
NETWORK SECURITY, USAGE OF RESOURCES
Mirz-Jiles Hosting wants our customers to get the most out of their hosting accounts. As a result, we encourage customers to utilize the wide variety of resources available to webmasters in building their sites. These include programs, scripts, and other tools. However, please remember that Mirz-Jiles Hosting accounts operate on shared network resources. While we make every efforts to assure there are sufficient resources for all of our account holders, the excessive use or abuse of these resources by one customer may have a negative impact on all other customers. Repeated misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in suspension and/or termination of your account.
Please note: We do understand that there are times a script will malfunction and cause a network problem. We are happy to try to work with our customers through these issues. Our main concern is with those with a disregard for others on the network, and repeat abusers of the resources.
Functions/sites which will inevitably cause an unacceptable strain on network resources and are therefore prohibited are:
- Unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Any software that interfaces with an IRC (Internet Relay Chat) network.
- Any bit torrent or similar file-sharing program.
- Operating as a gaming server, such as Counter-Strike, Half-Life, Battlefield1492, etc
ILLEGAL USAGE
Network Disruptions. Use of the Mirz-Jiles Hosting service for any activity
which affects the ability of other people or systems to use Mirz-Jiles Hosting
or the Internet will not be tolerated. This includes "denial of service"
(DOS) attacks against another network host or individual user. Interference
with or disruption of other network users, services or equipment is prohibited.
Mirz-Jiles Hosting will not tolerate any subscriber attempting to access the
accounts of others, or penetrate security measures of other systems, whether
or not the intrusion results in corruption or loss of data. Servers found hosting this material will be subject
to immediate cancellation without refund. Use of the Mirz-Jiles Hosting service
to access, or to attempt to access, the accounts of others, or to penetrate,
or attempt to penetrate, security measures of another entity's
computer software or hardware, electronic communications system, or telecommunications
system, whether or not the intrusion results in the corruption or loss of data,
is expressly prohibited and the offending Mirz-Jiles Hosting account is subject
to immediate termination.
ACCOUNT HOLDERS' RESPONSIBILITY
Security. You are responsible for any misuse of your account, even if the inappropriate
activity was committed by a friend, family member, guest or employee. Therefore,
you must take steps to ensure that others do not gain unauthorized access to
your account. In addition, you may not use your account to breach security of
another account or attempt to gain unauthorized access to another network or
server.
EMAIL
Our hosting accounts feature email services, including the ability to create and utilize mailing lists. While we encourage our customers to use this service, we absolutely prohibit any illegal or intrusive activities utilizing the email system. These activities include, but are not limited to:
Unsolicited E-mail, News Bombing, SPAM. Use of Mirz-Jiles hosting service to
transmit any unsolicited commercial or unsolicited bulk e-mail is expressly
prohibited. Violations of this type will result in the immediate suspension and/or termination
of the offending hosting account. In addition, Mirz-Jiles Hosting reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion, as well as making any such modifications in an emergency without notification to the account holder.
If you host websites or services that support
spammers or cause any of our IP space to be listed in any of the various spam
databases, you will have your website immediately removed from our network.
Malicious intent to impede another person's use
of electronic mail services or news will result in the immediate termination
of the offending hosting account. You will be accountable for all fees that
result from such actions.
Forgery or Impersonation. Adding, removing or modifying identifying network
header information in an effort to deceive or mislead is prohibited. Attempting
to impersonate any person or entity by using forged headers or other identifying information
is prohibited. The use of anonymous remailers or nicknames does not constitute
impersonation.
BACKUPS AND DATA LOSS
Every attempt
is made to make sure your site is up and running correctly. However, your use of this
service is at your sole risk. Mirz-Jiles Hosting is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our server.
In addition, we strongly urge our customers to choose passwords which are difficult to guess. Using a combination of letters, numbers, and or symbols is a good way to protect your account. Mirz-Jiles Hosting is not responsible for lost
content.
PAYMENT
Payments are due according to the terms selected at the time of account creation. Customers will receive an invoice via email and through their customer billing panel approximately 15 days prior to the due date. Mirz-Jiles reserves the right to suspend accounts that are overdue
without a refund for hosting time lost.
Accounts holders which do not pay by the due date will be charged a $5.00 late fee, and an updated invoice will be issued accordingly. Customers will have a period of 10 days after the due date to bring their account current (amount due plus late fee). If the account arreage is not cured within that time, the hosting account will be terminated without further notification.
If an account is terminated, the customer will have a period of 30 days in which to reactivate the account. All hosting charges, including late fees must be paid in full prior to reconnection. In addition, a reconnection fee of $20.00 will be assessed and must be paid prior to reconnection.
Mirz-Jiles Hosting reserves the right not renew accounts which have a repeated pattern of late payments and/or disconnection.
Due to the nature of our business, all services are pre-paid. No refunds will be given. Please keep this in mind when choosing a hosting payment. If you should choose to cancel an account, please notify us 7-10 days before the next billing cycle.
PRICE CHANGE
The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Mirz-Jiles Hosting, and the right to increase the amount of resources given to plans at any time.
INDEMNIFICATION
Customer agrees to indemnify, defend and hold harmless Mirz-Jiles.net and its agents, its customers, its officers and employees, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to your violation of this agreement, including but not limited to any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to indemnify, defend and hold harmless Mirz-Jiles.net against liabilities arising out of (i) any injury to person or property caused by any products sold or otherwise distributed in connection with Mirz-Jiles.net; (ii) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (iii) copyright infringement and (iv) any defective products sold to customers from Mirz-Jiles.net's server.
DISCLAIMER
Mirz-Jiles.net Hosting will not be responsible for any damages your business may suffer. Mirz-Jiles Hosting makes no warranties of any kind, expressed or implied for services we provide. Mirz-Jiles Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Mirz-Jiles Hosting and its employees.
OTHER
If any term, condition, or provision of this Legal Statement is determined to be unlawful, invalid, void, or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby. This Agreement and the resolution of any dispute related to this Agreement or the site shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any principles of conflicts of law. Mirz-Jiles Hosting and its agents's failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between Mirz-Jiles Hosting and its agents and you related to this agreement shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the State of Illinois, County of Cook.
